اشتراط العدالة في الولي؟
Answer
هذا هو المشروع عند العلماء؛ لا بدّ من العدالة. والقول بأنه لا يشترط قول قوي؛ لأن الرسول ﷺ أطلق لا نكاح إلا بولي ولا يعرف أنه استفصل، فإذا كان ما هو كافر؛ فالأمر واسع إن شاء الله ولو كان فيه بعض المعاصي. (دروس شرح بلوغ المرام، كتاب النكاح)
