Question
إذا أعطى رجلٌ صاحبَه شاةً أو ناقةً ينتفع بحلبها، ثم يردها، فهلكت عنده، فما حكمها؟
Answer
هذه منيحة، إذا هلكت تكون من ضمان صاحبها إذا لم يتعَدَّ عليها مَن كانت عنده ولا فرَّط، مثل الأمانات، فإنها تكون من ضمان صاحبها، أمَّا مَن كانت عنده فليس عليه شيء.
