Question
ما صحة عقد النكاح للمحرم وهو في الحج، هل يجوز؟ وهل يصح هذا العقد أم لا؟
Answer
النبي ﷺ يقول: لا يَنْكِح المحرم ولا يُنْكِح يعني لا يَنْكح: لا يتزوج، ولا يُنكِح: لا يُزوِّج غيره، مادام محرمًا؛ لأن عقده غير صحيح؛ لا لنفسه ولا لبناته أو غيرهن من مولياته ما دام محرمًا؛ لأن هذا أصل النهي: التحريم والإبطال.
